Taping raises legal, practical questions
Article Abstract:
Surreptitious taping of employer-employee conversations, to document employment discrimination or disciplinary proceedings, is legal, but raises other legal issues such as employee loyalty and the ethical standards for plaintiffs' attorneys. Federal law permits surreptitious recording but some states mandate the consent of all parties before tape recording can take place. A legally obtained tape recording is usually admissible as evidence, and admissibility usually depends on if the tape is audible.
